Terms of use

1. The parties

These terms are the contract between you and HYPER DEVELOPMENT ASC S.R.L. (CUI 48446947, J33/1192/2023), registered at Str. Principală nr. 711, room 1, Pătrăuți village, Suceava County, 727420, Romania (“we”), the company that operates Built by Days.

By using the app you confirm that you have read and accept these terms and the Privacy policy. If you don’t agree, don’t use the Service.

2. The Service

Built by Days is an app for daily habits. You pick a goal and a few habits, check in what you do, and every day you build adds a piece to a building. Finished buildings make up your city; at higher levels you unlock new buildings. You can see your progress, export your data, share your city and use widgets on your phone.

The app is available on iOS, Android and the web. Some features (widgets, reminders) exist only on the phone. The core is free and stays complete without a subscription.

3. Not a medical or emergency service

Built by Days helps you keep your habits. It is not a medical device, doesn’t provide diagnosis, therapy or medical, psychological or nutrition advice, and doesn’t replace a professional.

If you or someone else is in immediate danger, call 112 or your local emergency number.

4. Eligibility

You must be at least 16. To buy a subscription you must have the legal capacity to enter the contract or the consent of a parent or guardian.

5. Your account

You sign in with a code sent by email or with Apple or Google. You can also start without an email; until you save the account with an address, your progress is tied to that device and can be lost if you lose the device.

You are responsible for access to the email or the Apple / Google account you sign in with. You can’t sell or transfer the account. If you suspect unauthorised access, write to privacy@builtbydays.ro right away.

6. The AI Coach

The Coach is an AI assistant that helps you plan your days, come back after a hard stretch and adjust your targets. You turn it on only with your explicit consent and can turn it off at any time.

AI replies can be wrong or unsuited to your situation and are not professional advice. The Coach never changes anything in the app on your behalf. It has a daily and monthly message limit.

Don’t try to extract its instructions, get around its safety measures or use it for illegal or harmful content.

7. The public link and sharing

You can create a public link to your city. Anyone with the link sees the city, without your name and without your habits, until you turn it off. Images and clips you share can be copied by the people who receive them.

8. Your content

What you write in the app (goals, habits, notes, messages to the Coach) stays yours. You give us a non-exclusive, free and limited licence to host, process and display it only as needed to provide the features you use.

You confirm that you have the right to enter that content and that it doesn’t break the law or anyone’s rights.

9. Subscriptions, renewal and cancellation

The Premium subscription adds the AI Coach, the premium building collections, themes and city atmosphere, the advanced weekly report and the premium widgets. Building, the standard buildings, the city, stats, export, account deletion and privacy settings stay free.

It is bought in the app, through the App Store or Google Play; the store shows you the price, currency, taxes, length and any offers (for example a free trial or a lower first-year price) before you confirm.

The subscription renews automatically for the same period until you cancel it in your store account. Cancelling stops renewal and takes effect at the end of the period already paid.

Apple: Settings → your name → Subscriptions → Built by Days → Cancel Subscription.

Google Play: Google Play → your profile → Payments & subscriptions → Subscriptions → Built by Days → Cancel subscription.

Uninstalling the app or deleting your account doesn’t cancel the store subscription.

When the subscription ends, nothing you built disappears: a premium building already started can be finished, the theme and atmosphere go back to the free ones, and new premium choices need the subscription again. The free part stays yours.

10. Refunds and your consumer rights

Payments and refunds are processed by Apple (reportaproblem.apple.com) or Google Play under the store’s rules.

If you are a consumer, you keep all mandatory rights in your country, including conformity of digital services and the right of withdrawal where it applies. Nothing in these terms limits them.

11. Fair use

You may not: use the Service to break the law or other people’s rights; access other people’s accounts or data; get around the app’s limits or overload the infrastructure; scrape content; decompile the app except where the law allows; use the Service to train a competing product.

12. Intellectual property

The app, its design, buildings and illustrations, texts and the Built by Days brand belong to the operator or its licensors. You get a personal, non-exclusive, non-transferable and revocable licence to use the Service while you follow these terms. You are free to share images of your city for personal purposes.

13. Third-party services

The Service relies on providers such as Apple, Google, Supabase and the Coach’s AI provider, which have their own terms. We remain responsible for obligations the law doesn’t let us transfer.

14. Availability and changes to the Service

We do our best to keep the app working; check-ins are saved on your phone even when we can’t reach the server. The Service may be interrupted for maintenance or incidents. We may add, change or remove features, respecting the legal rights of those who paid.

We don’t guarantee any particular result (a habit kept, a level reached) from using the app.

15. Suspension and termination

You can stop using the app and delete your account at any time in You → Account → Delete account.

We may suspend access for security, fraud or breach of these terms, and close an account for a serious or repeated breach. Where law and safety allow, we tell you why and how to appeal.

16. Warranties and liability

The Service is provided “as is”, to the extent the law allows. For consumers we don’t exclude mandatory guarantees on the quality and conformity of digital services.

To the extent the law allows, we are not liable for indirect or unforeseeable losses or for decisions made based on an AI reply. These limits don’t apply to fraud, intent, personal injury or any liability that can’t be limited.

17. Changes to these terms

We may change these terms when the Service, the business model or the law changes. For an important change we tell you in the app at least 30 days before. If you don’t agree, you can stop using the app and cancel your subscription before it applies.

18. Governing law and disputes

Romanian law applies. If you are a consumer in another country, you keep the mandatory protection of your country’s law.

Before any action, write to privacy@builtbydays.ro so we can settle it amicably. As a consumer you can also use the alternative dispute resolution of the Romanian consumer authority, ANPC (reclamatiisal.anpc.ro), without losing your right to go to court.

19. General

If a clause can’t be enforced, the rest of the terms still apply. Not exercising a right doesn’t mean we waive it. We may transfer the contract in a reorganisation or sale, with the notice the law requires and without reducing your rights.
